The Occupational Safety and Health Administration (OSHA), within the U.S. Department of Labor (DOL), issued an interim final rule and has invited comments on the enforcement of the new whistleblower rule under the Patient Protection and Affordable Care Act (which Act is commonly known as Obamacare). The rule offers protection to employees from retaliation by their employers for reporting violations of the new tax credit or cost sharing reduction provisions and prohibits retaliation against employees who report violations of the Act’s ban on exclusions for pre-existing conditions.
