Most purchase and sale agreements, leases, mortgages, insurance policies, construction contracts and other real estate related contracts have provisions which control in the event of casualty or damage to property caused by hurricane Sandy or at other times. Amongst other things, the contract provisions may relate to insurance, responsibility for repair or reconstruction, notice obligations, rights to terminate, delays and the like. The contracts should be reviewed carefully to be certain that all technical and substantive rights and obligations are addressed.
