Is there anything that a HOA's can do to get the State Of New Jersey, to make the Local Government, to maintain, and clean the storm water drains. This is very expenseive, and with the Clean Water Act, it could be a recurring additional cost to all HOA in New Jersey? Thanks for any information.
Mr. Hannum. Thank you for your blog post regarding the maintenance of Storm water drains. Unfortunately, I know of no statute or regulation, statewide, by which your municipality could be compelled to clean and/or maintain your storm water drains. New Jersey's Municipal Services Act does not include this within the services that a municipality must provide to a private community.
Perhaps your municipality maintains an ordinance(s) which could be helpful?
I would be happy to discuss this with you further if you would like.
