NJ Senate Judiciary Committee Endorses Irreconcilable Differences Bill
John Eory, a shareholder in the Divorce group, was quoted in Adding Divorce Causes Endorsed in today's Asbury Park Press. The legislation calls for divorce being granted on the grounds of "irreconcilable differences which have caused the breakdown of the marriage for a period of six months."
In commenting on the bill, Eory says, "This will now allow for people not to find fault with each other when it need not be. It will allow people some measure of relief to not have to put down things which aren't true."

Has there been any update on this and how long will it take to actually become law?

Thank you for your inquiry regarding the status of the pending irreconcilable differences bill. Having been passed by both houses of the Legislature, it is presently on Governor Corzine's desk. I and others are hopeful he will sign it into law shortly.
I have heard on a NYC radio station that this is now the law.
1) Is it true? If so, when is it effective?
2) When does the 6-month period start? Do you need to start divorce proceedings first, or do you just need to live apart for 6 months?
FYI: Governor Corzine signed the irreconcilable differences divorce bill into law on January 23,2007. It becomes effective immediately.
Thanks for your question. The new law is effective immediately and there is no separation requirement. A person can file for divorce under this ground while still living with his or her spouse as long that the one year NJ residency requirement is met.
Has NJ ever had irreconcilable differences as a grounds for divorce? If so, what year?

In response to your inquiry, the above ground has just been added to NJ divorce law, effective immediately. One must allege irreconcilable differences for six or more months. The parties do not have to be separated.
